1. Minimum shelf life remaining when food products arrive in the destination country

In Ukraine, there are no regulatory requirements for the minimum shelf life of imported food products. 

All requirements as to the minimum shelf life are set out on a contractual basis and/or on the basis of the manufacturer’s or importer’s internal rules and technical documentation. 

The minimum shelf life for imported products is also set out in public procurement tenders. 

2. Minimum shelf life remaining of food products sold in the country 

There are no specific regulatory requirements about the minimum shelf life of imported food products. As a general principle, it is only allowed to sell food products for which the shelf life has not expired [1].

All requirements as to the minimum shelf life are set out on a contractual basis and/or on the basis of the manufacturer’s or retailer’s internal rules and technical documentation.  

The minimum shelf life is also set out in public procurement tenders. 

Food products with an expired shelf life are considered dangerous and must be withdrawn from all sales. [1] [2]

3.  If nothing is specified in legislation, are there food industry guidelines/best practices?

It is a common practice to require (e.g. in public procurement tenders) that the minimum remaining shelf life must be around 80-90% of the total shelf life set out by the product manufacturer. This especially applies if a product is of a perishable type (e.g. dairy, meat, fish, or poultry). 

Example of public procurement tender: 

  1. Tender for procurement of meat and poultry – the minimum remaining shelf life must be 90%. 
  2. Public procurement tender for whole grain flour –  the minimum remaining shelf life must be 80%. 
  3. Public procurement tender for hard cheese – the minimum remaining shelf life must be 80%.

 

Conclusion
    1. In Ukraine, there are no regulatory requirements about the minimum shelf life of imported food products or products sold on the market. The minimum remaining shelf life of food products in the Ukrainian market is mainly regulated by:
      • Contracts
      • Internal regulations of retailers
      • Conditions of Public Procurement Tenders
    2. In practice, the most common conditions for a minimum shelf life for perishable goods are that the minimum shelf life must be around 70-90%.
