This section provides information on any product notification or registration and manufacturing site registration processes.

6.1 Product Notification

General Food

Product notification is not required for General Food products; however, compliance with the Food Act 1983 [1] and its subsidiary legislation Food Regulations 1985 [2] is mandatory.

Alcoholic drinks

Same as "General Food" above.

2) Whisky

6.2 Product Registration

General Food

Product registration is not required for General Food products; however, compliance with the Food Act 1983 [1] and its subsidiary legislation Food Regulations 1985 [2] is mandatory.

However, an import permit is required for the importation of Liquor with the Royal Malaysian Customs Department through Customs Form No.12 (please refer to the Procedure For Application Of Import Licence For Cigarette, Tobacco & Liquor) [5].

Under Regulation 42, Customs Regulations 2019 [4] mentioned that any importation of intoxicating liquor and denatured spirits is subject to a license issued by or under the direction of the Director General of Customs.

The RMK Import License Fee charged is as much as RM4,800.00 (Ringgit Malaysia Four Thousand Eight Hundred) as prescribed under Regulation 43(2), Customs Regulations 2019 in force.

6.4 Manufacturing Site Registration

General Food

As required under Regulation 3, Food Hygiene Regulations 2009 [3], local food premises must be registered with the Ministry of Health Malaysia. Four (4) classification categories are as follows:

  • P1 – All food premises involved in food manufacturing
  • P2 – All food premises involved in catering and mass food catering
  • P3 – "Outlet" food such as restaurants, stalls, canteens, and so on where food is prepared, processed, stored, and served for sale
  • P4 – All vehicles used to sell ready-to-eat food

Registration of the food premises must be done by the premise owner through an online application addressed at http://fosim.moh.gov.my/.

The validity period for a premise registration is three years from the date it is issued. Upon expiry, the registration of the premises must be renewed to enable food sales activities to be carried out.

According to recent information from the authorities, the issuance of new manufacturing licenses for alcoholic beverages in Malaysia has been discontinued. Consequently, applications for new licenses are not currently being accepted. This means that establishing new factories for the production of alcoholic beverages in Malaysia is not presently permitted.

6.4.1 Standard/Rules for Manufacturing Site

General Food

Local manufacturing sites must comply with three key regulations: the Food Act 1983 [1], the Food Regulations 1985 [2], and the Food Hygiene Regulations 2009 [3]. There are currently no additional specific standards or guidelines available.

Note: For imported food, the Food Hygiene Regulation 2009 [3] serves as a valuable reference, although it does not directly apply. However, foreign manufacturers must still comply with the Food Act 1983 [1] and Food Regulations 1985 [2], which ensure food safety and quality for imported goods.
