4. Labeling Requirements

4.1 Mandatory Labeling Parameters

Packaged donuts 

Same as "Category" above.

Non-Packaged donuts 

Since there is no labeling regulation for non-packaged foods, those non-packaged donuts can be sold in packaging containing only the brand name of the product/franchise, as these are products with a short shelf life and delivered on demand.

Product

According to Article 9 of Resolution RDC N° 727/2022 [1], the statement of the sales denomination must observe, at least, one of the denominations established in the norms that define the identity and quality standards of the food. 

However, donuts themselves are not described in the local regulations. In practice, in the absence of specific names in the regulations, the products may be named with names established by usage, whereby expressions relating to the ingredient characterizing the product, the production process, the form of presentation, the purpose of use and/or the specific characteristic could be added.

After performing market practices search, products labeled as Donuts have been identified ("Donuts with chocolate", "Donuts with doce de elite", "Frozen Donuts with...- the name of the topping", etc.). 

Based on the above-mentioned information, it is our best understanding that the products of interest can be labeled as "Donuts with - name of the topping -" (“Donuts de…” in Portuguese). This name must appear on the main panel in contrasting colors to ensure its correct visibility.

4.5 Product-specific Labeling Statements

Category

According to Chapter III labeling of Decree Law 986/1969 [2], the label must bear the following statements, when applicable:

  1. Food labels that contain artificial coloring must bear the statement "Artificially Colored" on the label.
  2. Food labels added with natural or artificial essences, with the aim of reinforcing or reconstituting the natural flavor of the food, must bear the statement "Contains Flavoring...", followed by the corresponding code and the statement "Artificially Flavored", in case artificial aroma is used.
  3. Food labels made with natural essences must bear the indications "Flavor of ..." and "Contains Flavoring", followed by the corresponding code.
  4. The labels of foods made with artificial essences must bear the indication "Imitation or Artificial Flavor of ..." followed by the statement "Artificial Flavored".
