At the Community level, there is no harmonized EU legislation applicable to donuts with toppings. Consequently, various horizontal Community provisions related to foodstuffs in general (labeling, additives, etc.) are applicable, and National legislation applies where relevant. In Spain, there is national legislation regulating aspects related to the quality of biscuits and the manufacture, circulation, and trade of pastry, bakery, confectionery, and confectionery products [1].

Royal Decree 496/2010, of 30 April [1], establishes the quality standard for confectionery, pastry, and bakery products, being our best understanding that, donuts with toppings are placed under this general category of products, specifically under the one for pastry (“productos de bolleria” in Spanish).

In Spain, various communities have published the respective Technical Artisan Standard for Bakery, Pastry, and Confectionery Products [2]. Although these standards are applicable to artisan products, they provide an approximation of the exact product classification, confirming that donuts in general, are placed under the above-described regulation.

Definition

Pastry products (“productos de bolleria” in Spanish): these are foodstuffs made basically from fermented flour dough and which have undergone an appropriate heat treatment. They may contain other foods, bakery supplements, and authorized additives.

Types of pastries: ordinary pastries, without filling or garnish, and filled or garnished pastries, which before or after appropriate heat treatment have been filled or garnished with different sweet or savory foodstuffs.
